Section 1: Product Delivery & Guarantee

1.1 Digital Products

All Empower Cove products are delivered digitally. Upon successful purchase and payment processing, you will receive immediate access to your product(s) via email. No physical goods are shipped.

1.2 30-Day Money-Back Guarantee

Empower Cove stands behind its products with a 30-day money-back guarantee. If you're not satisfied with your purchase for any reason, you are eligible for a full refund within 30 days of purchase.

1.3 Access & Account Security

  • You are responsible for maintaining the confidentiality of your account login credentials
  • You agree not to share your account access with others
  • Empower Cove reserves the right to revoke access if Terms of Service are violated
  • Upon refund approval, your access will be revoked within 24 hours

Section 2: Acceptable Use & Intellectual Property

2.1 License Grant

Upon purchase, you receive a non-exclusive, non-transferable license to use the template for your own therapy practice. This license permits you to:

  • Customize the template for your specific practice needs
  • Store client and practice data within the template
  • Use the template for practice management and administrative purposes

2.2 Prohibited Uses

You agree NOT to:

  • Share, distribute, or resell the template to others
  • Permit others to access or use your account
  • Remove or alter Empower Cove branding, copyright notices, or licensing terms
  • Use the template for purposes other than managing your own therapy practice
  • Modify the template's core code or structure in ways that circumvent licensing
  • Reverse-engineer or attempt to derive the underlying template design

2.3 Intellectual Property Rights

All templates, video content, email sequences, and materials provided by Empower Cove remain the exclusive intellectual property of Empower Cove. Your purchase grants you a usage license only; it does not transfer ownership.

2.4 Your Data

You retain all ownership rights to client data, practice information, and customizations you enter into the template. Empower Cove claims no ownership over your data. However, if your account access is revoked (including following a refund), you will lose access to that data.

Section 3: Limitations on Liability & Refund

3.1 Service as-Is

Digital templates are provided "as-is." While Empower Cove makes every effort to ensure products function as described, we make no warranty that the template will meet every aspect of your practice needs, be error-free or uninterrupted, or save a specific number of hours per week.

3.2 Money-Back Guarantee as Sole Remedy

If you're not satisfied with a product, your sole and exclusive remedy is the 30-day money-back guarantee outlined in our Refund Policy. You waive any other claims, damages, or remedies.

3.3 Liability Waiver

To the maximum extent permitted by law, Empower Cove is not liable for indirect, incidental, consequential, or punitive damages, lost revenue, lost profits, lost opportunity, damages arising from use or inability to use the template, or data loss or corruption (you are responsible for backing up your data).

Section 4: Termination of Access

4.1 Termination by Empower Cove

Empower Cove may terminate or suspend your access to purchased products if you violate any provision of these Terms of Service, engage in fraudulent or deceptive conduct, share the template with others or attempt to distribute it, or violate intellectual property rights.

4.2 Termination & Refunds

Termination for violation of Terms of Service does not entitle you to a refund. However, if Empower Cove terminates access without cause, you may be eligible for a prorated refund.

Section 5: Support & Updates

5.1 Support Scope

Empower Cove provides email support for technical issues accessing or using the template, questions about features and functionality, and assistance with initial setup (for Premium plan customers).

5.2 Updates & Changes

Empower Cove may update or modify templates at any time, including bug fixes, performance improvements, feature additions, design changes, and deprecation of certain features. We will notify users of significant changes via email.

Section 6: Payment, Billing & Taxes

6.1 Payment Methods

Empower Cove accepts major credit cards and other payment methods as displayed at checkout. All payments are processed securely.

6.2 Billing Accuracy

You agree to provide accurate billing information. You are responsible for notifying us of any unauthorized charges within 30 days of the transaction.

6.3 Taxes

Depending on your location, sales tax or other applicable taxes may be added to your purchase. You are responsible for paying any taxes owed.

Section 7: HIPAA & Data Privacy

7.1 HIPAA Compliance

While Empower Cove templates are designed with therapy practice management in mind and include HIPAA compliance guidance, Empower Cove is not a HIPAA Business Associate by default.

7.2 Your Responsibility

You are responsible for ensuring your use of the template complies with HIPAA and all applicable regulations, obtaining appropriate Business Associate Agreements with any third-party integrations, and implementing additional security measures if required by your compliance obligations.

Section 8: Dispute Resolution & Governing Law

8.1 Refund Disputes

Disputes regarding refund eligibility will be resolved through contact with support@empowercove.com. Empower Cove will review and respond within 5 business days. If you disagree with the decision, you may appeal within 7 days, and appeals are reviewed by management and resolved within 5 business days.

8.2 Arbitration

To the extent permitted by law, any dispute arising from these Terms of Service or your use of Empower Cove products will be resolved through binding arbitration rather than court proceedings.

Section 9: Modifications to Terms

Empower Cove may modify these Terms of Service at any time. Modifications become effective upon posting to our website. Your continued use of our products after modifications indicates your acceptance of the updated terms.

By purchasing from Empower Cove, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Refund Policy.
